    1. About Risknado

Risknado ("Risknado", "we", "us" or "our") is an online software platform that helps businesses identify, score and manage operational, financial, compliance, strategic and other business risks (the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you must not use the Platform.

If you are using the Platform on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these Terms.

    2. Eligibility and Age Restrictions

The Platform is intended for business use only.

You must be at least 18 years old and legally capable of entering into a binding contract to create an account or purchase access.

Only corporate or business email domains (for example, @smithsplumbing.com) may be used to sign up. Generic email domains such as @gmail.com, @hotmail.com, @outlook.com, @yahoo.com, @protonmail.com and similar are not accepted, as your email domain is tied to your Risknado account. If you create an account using a generic email domain, you will not be able to use the Platform.

If we discover that a user under 18 has created an account or made a purchase, we may terminate access and, where required, refund any payment made.

    3. Description of the Platform

Subject to these Terms and any order or purchase confirmation, Risknado provides:

    • Access to a structured library of business risks, including descriptions and real world examples.
    • Tools to add risks to your register, adjust risk scoring and track mitigation actions.
    • Features to invite and manage users within your organisation, subject to any user limits that apply to your plan.
    • Ongoing product maintenance and improvements, at our discretion.

Access is provided digitally through the web and is typically activated immediately after successful purchase.

The Platform is a general business tool and does not replace legal, financial, insurance or professional risk advice.

    4. Accounts and Security

To use the Platform, you must create an account and provide accurate, current and complete information.

    You agree that:

    • You are responsible for all activity that takes place under your account.
    • You will keep your login details secure and will not share them outside your organisation.
    • You will notify us promptly at support@risknado.com if you suspect any unauthorised access to your account.

We may suspend or terminate accounts that:

    • Breach these Terms,
    • Misuse the Platform,
    • Attempt to circumvent security or user limits, or
    • Use false or misleading registration details.

    5. Pricing and Payment

Access to the Platform is sold as a one time purchase, currently priced at 3,999 USD for lifetime access, inclusive of any applicable taxes where required.

Payments are processed securely by Stripe or another third party payment processor. We do not store full card numbers on our systems.

Access is granted once the payment is successfully processed.

All prices are subject to change, but any change will not affect purchases that have already been completed.

You are responsible for all charges, taxes and duties arising from your purchase, except for taxes based on our income.

    6. "Lifetime" Access

"Lifetime access" refers to the operational lifetime of the Risknado Platform, not to the lifetime of any individual or business.

Your access will continue for as long as we choose to operate and maintain the Platform in a commercially reasonable way.

We may at some point decide to discontinue or materially change the Platform. In that case, we will provide reasonable notice by email or by posting a notice on the website before closure or material change.

We are not required to operate the Platform indefinitely.

    7. Platform Updates and Changes

We may modify, update or remove features of the Platform at any time, including:

    • Interface changes or performance improvements,
    • Adjustments to risk categories or risk descriptions,
    • New features or the withdrawal of features that are no longer supported.

We will try to ensure that changes improve overall usability and reliability. However, we do not guarantee that any particular feature, risk entry or part of the Platform will remain available in its current form.

    8. Refund Policy

Because the Platform is a digital product that provides full access immediately after purchase:

All sales are final and non refundable.

If you experience a technical issue that prevents you from accessing the Platform, contact support@risknado.com within 7 days of purchase with details of the problem. We will work with you to restore access as quickly as we reasonably can.

Statutory consumer rights that apply under the laws of England and Wales are not affected.

    9. License to Use the Platform

Subject to these Terms and payment of applicable fees, we grant you a limited, non exclusive, non transferable and revocable licence to:

    • Access and use the Platform for your own internal business purposes, and
    • Allow your authorised team members or employees to access and use the Platform under your account, within any user limits that apply.

    You must not:

    • Copy, resell, publicly display, distribute or sublicense the Platform or its content, except as needed for your internal business use,
    • Attempt to reverse engineer, decompile or otherwise attempt to access the underlying source code or database structure,
    • Use the Platform to build a competing product or service that uses substantial parts of the Risknado risk library or interface, or
    • Remove or obscure any copyright, trademark or other proprietary notices.

All intellectual property rights in the Platform, including the risk library, documentation, branding and visual materials, are owned by Jonathan McCallum or his licensors. No rights are granted to you other than those expressly stated in these Terms.

    10. Your Content

You may add your own content to the Platform, including:

    • Custom risks, descriptions and notes,
    • Mitigation actions and related comments,
    • User names and business information.

You retain all rights in your own content. You grant us a non exclusive, worldwide licence for the duration of your use of the Platform to host, store, process and display that content as needed to provide the Platform and related support to you.

    You confirm that:

    • You have all necessary rights and permissions to input your content into the Platform,
    • Your content will not infringe any third party rights or break any applicable law, and
    • You are responsible for backing up any important content for your own records.

    11. Acceptable Use and Prohibited Content

You agree that you will not use the Platform to:

    • Break any applicable law or regulation,
    • Upload or store content that is unlawful, defamatory, discriminatory, abusive, hateful, harassing or otherwise objectionable,
    • Upload malicious code, viruses or anything that could harm the Platform or other users,
    • Attempt to gain unauthorised access to any part of the Platform or related systems, or
    • Overload or interfere with the normal operation of the Platform.

11.1 No Sensitive or High Risk Personal Data

The Platform is designed for general business risk information and related notes. It is not intended to store special category personal data or highly sensitive information.

You agree not to use the Platform to store or process:

    • Health or medical information about identifiable individuals,
    • Biometric identifiers,
    • Full payment card numbers, bank account numbers or similar financial identifiers,
    • Government identification numbers such as passport numbers or national insurance numbers,
    • Information about children, or
    • Other information that qualifies as special category data under UK GDPR.

If you choose to upload such information against our guidance, you do so at your own risk and we will not be responsible for any loss, damage or liability that results.

    12. Third Party Services and Infrastructure

    12.1 Core Service Providers

Risknado is built and operated using third party platforms and infrastructure, including:

    • Application builder and hosting services provided by Lovable Labs Incorporated ("Lovable"),
    • Managed database, authentication and storage services provided by Supabase Inc. ("Supabase"),
    • Payment processing services provided by Stripe, and
    • Other web, analytics and infrastructure providers as required.

These providers help us run the Platform but do not provide any direct contractual rights to you. Your use of the Platform may also be subject to their publicly available terms and privacy policies.

    12.2 Dependencies and Limitations

    You understand and agree that:

    • The availability, performance and security of the Platform depend in part on these third party providers and on the public internet, which we do not control.
    • Interruptions, delays, data loss or security incidents can occur due to issues with those providers or events outside our reasonable control.

We are not responsible for any unavailability, delay, data loss, corruption or other problem that is caused by:

    • outages or failures of Lovable, Supabase, Stripe or other infrastructure providers,
    • internet or network problems on your side or between you and our providers, or
    • force majeure events such as natural disasters, war, civil unrest, strikes or failures of power or telecommunications.

We will use reasonable efforts to coordinate with our providers to restore service where interruptions occur.

    13. Platform Availability

We aim to provide reliable access to the Platform, but:

    • We do not guarantee that the Platform will always be available, secure or free from errors,
    • Planned maintenance or updates may result in temporary downtime, and
    • Unplanned outages can occur due to technical issues or third party failures.

You are responsible for maintaining your own copies or exports of important risk data. We do not guarantee specific backup schedules, retention periods or disaster recovery recovery time objectives.

    14. Disclaimers

The Platform and all content provided through it are supplied on an "as is" and "as available" basis.

Without limiting the generality of the above:

    • Risknado provides general business risk information and tools for educational and informational purposes only.
    • Risknado does not provide legal, financial, insurance, compliance or professional advice.
    • You and your advisers are solely responsible for assessing risks, choosing mitigation strategies and making decisions in your organisation.

    We do not promise that:

    • The risk library is complete, up to date or suitable for your specific industry,
    • Any particular risk or mitigation will prevent a loss or incident, or
    • The Platform will identify every relevant risk that may affect your business.

You should always apply your own judgment and, where appropriate, obtain professional advice.

    15. Limitation of Liability

To the maximum extent permitted by law:

    • We are not liable for any indirect, incidental, special, consequential or punitive loss or damage, including loss of profit, revenue, data, goodwill or business opportunities, arising out of or in connection with your use of, or inability to use, the Platform.
    • Our total aggregate liability to you for all claims of any kind arising out of or relating to the Platform or these Terms will not exceed the total amount you have paid to us for access to the Platform.

Without limiting the above, we will not be liable for any loss, damage or expense that arises from:

    • Failures, unavailability or security incidents affecting Lovable, Supabase, Stripe or any other third party provider we use,
    • Internet or network problems, or
    • Events outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the laws of England and Wales, such as liability for death or personal injury caused by negligence, or for fraud.

    16. Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy, which is available at:

    https://risknado.com/privacy

By using the Platform, you agree that we may collect, use and share your personal data as described in the Privacy Policy.

For the purposes of UK GDPR, Risknado (operated by Jonathan McCallum, United Kingdom) is the data controller of personal data processed through the Platform. Our core service providers, including Lovable, Supabase and Stripe, act as data processors on our behalf.

    17. Termination

You may stop using the Platform at any time. Because access is sold as a one time purchase, you will not normally be entitled to a refund if you choose to stop using the Platform.

We may suspend or terminate your access, without refund, if:

    • You materially breach these Terms or applicable law,
    • You use the Platform in a way that could damage or disrupt our systems or another user's use, or
    • We reasonably believe your account has been compromised or is being misused.

On termination, your licence to use the Platform ends. We may retain and use anonymised or aggregated data for analytics and product improvement.

    18. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Platform, our business or applicable law.

The latest version will always be available at https://risknado.com/terms

Changes will apply from the date they are posted on the website.

If you continue to use the Platform after the updated Terms take effect, you will be deemed to have accepted the changes.

If you do not agree with updated Terms, you must stop using the Platform.

    19. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Platform, are governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction over any such dispute or claim.
